Unresolved Problems Segment: Confronting Dr. Tiller's attorney |

Pedro Irigonegary: "What's important is what medical people and a woman going through a difficult process decide is for her best interest. I don't care what Mr. O'Reilly thinks." Jesse Watters: "Do you believe depression is a reason to terminate a pregnancy ... a lat-term pregnancy?" Irigonegaray: "What's important is what the law and the constitution require. .. That's the kind of junk journalism that I see from Mr. O'Reilly on a daily basis. Junk journalism. ... You're not talking about protecting children, you're talking about something to get ratings. ... You have no idea what you're talking about ...You, and Mr. O'Reilly, and the entire Fox Network are not the individuals that should make the determination of what is, or is not, illegal abortion." |

Culp: "We have official state statistics that show that us that none of the late terms since 1998 ... have been to prevent the death of the mother. ... All of the partial birth abortions that were done were for the mental health of the mother ..." O'Reilly: "There's a difference between partial birth abortion and late term. We understand that Tiller has stopped doing partial births since 1999, but he does late term. The difference is purely a physical way of killing the baby. ... What Tiller does is late term abortion. Tell us what the procedure is there. How does he terminate the fetus?" Culp: "His preferred procedure is to find the baby's heart on the sonogram, inject it with a poison, kill the baby, then put the mother into labor. ... He has a crematorium on the property. People that stand outside and pray report there are days when ashes actually fall on them." "... we wonder what Dr. Tiller has to hide ... why our Attorney General is not allowed to enforce the law." O'Reilly: "...This is horrendous." |

The Factor pointed out that the Supreme Court is hearing arguments about late term abortion. "Depression covers everything, and the Supreme Court is faced with a decision - is the United States going to let a woman walk in with a viable baby in her womb and terminate the baby? O'Reilly: "Megan, on a national level, the Supreme Court is now looking at partial birth abortion, which doesn't really take into account late term? Does it?" Kendall: "No, that was one of the things the Court was kicking around today. ... As you pointed out, in late term abortion, like the ones that Tiller is doing, the child can be killed inside the womb. ... That's not banned. ... I don't know that Tiller would be affected by the Supreme Court decision" about partial birth abortion. ... |

O'Reilly: "It will be interesting to see if the Supreme Court broadens the ruling out, because Tiller has found a loop hole in these late term term abortions." "...We will stay on this story. This is horrendous." |
