— Government review teams appointed
by Gov. Kathleen Sebelius before she took office did not have
to conduct their meetings in public until after her inauguration, the
Kansas Court of Appeals ruled Friday.
The
three-judge panel affirmed Shawnee County District Judge Eric Rosen's
ruling that the teams, established by the governor-elect's transition
office, were not a state agency as defined by Kansas law. News
organizations argued the teams were subject to the Kansas Open
Meetings Act.
BUT,
why didn't Judge Eric Rosen recuse himself in that case because of his
wife's political connections to Sebelius? Did he disclose the following
information about his wife's contributions to Sebelius before he made
his decision?

The
state voter registration at the Secretary of State's office shows that
both Elizabeth Rosen (Democrat, age 49) and Eric Rose (Democrat, age 50)
live at this address. There is little doubt that this is the
right judge and the right Sebelius' contributor.
Why
didn't Rosen recuse himself in this case? Why doesn't the press
report this conflict of interest?
